No Bagno Center – BOYCOTT BAGNOCENTER.IT AND ORO START SRL

NOTICE: The purpose of this website is to have www.bagnocenter.it refund a Client EUR 587,68 in accordance with law, and to encourage buyers to boycott the company, its parent Oro Start Srl, and all suppliers until the amount is paid in full. ITALIAN

WHO

Bagno Center is an online retailer of bathroom products including bathroom furniture, bathtubs, bidets, DIY flooring, faucets, grab bars, shower enclosures, sinks, and toilets. The company is owned by Oro Start Srl, who appears to be in Liquidation, and is managed by Marco Iacomucci and Giannetto Paluzzi; their direct email addresses are marco@orostart.it and giannetto@orostart.it, respecively. I was a private Client of Bagno Center who was defrauded by the company.

I purchased one sink, two bidets, and two toilets from Bagno Center. Bango Center did not list a sink model in the collection, so I purchased the other sink from Casa Omnia. Casa Omnia informed me the sink ordered was discontinued, and I was promptly refunded. After an exhaustive search for the other sink, including learning the entire collection had been discontinued by the manufacturer, I cancelled the order with Bagno Center. A company representative told me I could not cancel my order, so with a deadline approaching for plumbing and tile I purchased another sink in the collection from Bagno Center.

My initial purchase with Bagno Center was made on WE 05/08/24, and my order with Casa Omnia was made the same day. On TH 05/09/24 Casa Omnia informed me the sink ordered was no longer available. I provided my bank details to Casa Omnia on FR 05/10/24, and on MO 05/13/24 I received a refund in full. After an exhaustive search for the other sink, including learning the entire collection was discontinued by the manufacturer, on MO 05/20/24 I cancelled my order with Bagno Center. To be clear, there was never any communication from Bagno Center since placing my order on MO 05/08/24; approximately two-weeks had elapsed. On MO 05/20/24 Bagno Center informed me I could not cancel my order, so later the same day I purchased another sink in the collection from them. On SU 05/26/24 I exercised my Right to Withdrawal with Bagno Center.

WHEN

LAW

Article 9 of Directive 2011/83/EU of the European Parliment and of the Council affords consumers the ‘Right of Withdrawal’ from a distant or off-premise contract within 14-days from the receipt of goods, without giving any reason, and without incurring any cost. The Italian equivalent of this Directive is Article 5 of Legislative Decree No. 185/99. Bango Center is aware of the law, including having it referenced on their website, but they do not appear to act in accordance with European Union or Italian law.

WHY

Bagno Center rejected my Right to Withdrawal on MO 05/27/24, so on WE 06/12/24 I filed a formal complaint against the company through the European Commission Online Dispute Resolution (ODR) platform. Bagno Center fabricated a reply to the complaint, a Dispute Resolution Body was not agreed upon, so the complaint time expired. On WE 06/27/24 I informed Bagno Center legal action was going to commence on MO 07/22/24. On MO 07/22/24 Bagno Center refunded me EUR 1.370, and indicated the EUR 587,68 amount outstanding was for ‘administrative costs’ incurred, which is not in accordance with law.

EGREGIOUS

The business practice of Bagno Center is egregious as the products ordered were never dispatched from the manufacturer. To be sure, Bagno Center does not inventory products, so they rely on drop-shipping from the supplier to fulfill orders. It is my opinion, and that of the European Commission, Bagno Center’s website is ‘misleading to consumers’, if not grossly.

Another complaint was filed through the European Commission ODR platform on 07/26/24, claiming the EUR 587,68 balance outstanding, but Bagno Center never responded to the complaint and it too time expired. On 12/13/24 I filed a suit against Bagno Center through the European Commission Small Claims Procedure. Bagno Center fabricated a different response to the Commission, and the suit elapsed due to an administrative matter. The following summarizes the next steps to be taken against Bagno Center.

HOW

01/01/26 – Launch No Bagno Center website at https://nobagnocenter.com, and apprise the company of the same via email.

01/01/26 – Request from Bagno Center payment in full of outstanding balance, or EUR 587,68, by not later than WE 01/07/26.

03/02/26 – If Bagno Center does provide at least proof of payment for EUR 587,68 by WE 01/07/26, then all company suppliers, including those of Oro Start Srl, will be notified of this website. Suppliers will also be asked to contact Bagno Center requesting the company provide the refund in full.

03/06/26 – If payment in full of outstanding balance, or EUR 587,68, is not received from Bagno Center by FR 03/06/26, then private counsel will be contacted as early as MO 03/09/26 in order to initiate legal action against the company; criminal action against the directors will also be explored.

03/09/26 – In addition to the legal (and criminal) action referenced above, all Bagno Center and Oro Start Srl suppliers will be notified of the action, and they will be encouraged to ‘call’ or collect on any outstanding receivables with the company as the maximum financial penalty afforded by European Community and/or Italian law will be purused.

05/01/26 – In addition to pursuing the matter through private counsel (WE 04/22/26), I am now encouraging prospective buyers to boycott Bagno Center, its parent Oro Start Srl, and all company suppliers for enabling Bagno Center to operate outside the law. Supplier names will be removed from the ‘marchi’ listing above by copying me on a ‘Demand for Payment’ email to Bagno Center, or when payment in full of EUR 587,68 is received.

HOW MUCH

I am owed EUR 587,68 from Bagno Center, and this is the only amount I am seeking at this time. If the balance is timely paid on or before WE 01/07/26, then I will consider the matter satisfied and seek no further action against Bagno Center. Otherwise, I will file a suit against Bagno Center through private Counsel, and seek the maximum penalty against the company and its directors. The European Commission indicated the Small Claims Procedure award was going to be EUR 5.000 to EUR 25.000 given the ‘egrigous’ business practice of Bagno Center, and their ‘complete disregard’ for the law.
